Tyler Ball told the Nova Scotia Supreme Court on Tuesday that the female accuser in his sex assault trial was asked repeatedly for consent.
“I would never force myself on anyone,” Ball testified in the Antigonish courtroom.
Ball and fellow X-Men football player Jonah Williams are each being tried jointly on a single count of sexual assault.
The allegation stems from a Nov. 17, 2017 party at St. Francis Xavier University’s Cameron Hall.
The woman, a then-first-year student who testified last week, said that she and Williams were having consensual sex when there was a knock at his dorm room door.
That’s when Ball, two other X-Men football players and another male friend were invited into the room by Williams to fill up their drinks.
Ball testified that while the young woman was covered up with sheets on the bed they spoke with Williams about an “almost fight” that just happened on the floor above.
Then Williams asked about group sex.
Ball said that Williams asked the young woman on the bed if she’d take part in a threesome and she replied, “Yeah sure.”
Williams then ruled out two of the men in the room because they had girlfriends and a third declined.
Ball testified that when Williams asked the woman about including himself in a threesome, she said, “Sure, I don’t care.”
Then the other three left the dorm room.
“I said, ‘Are you sure you’re OK with this,'” said Ball of allegedly getting the woman’s consent.
“Then Jonah asked and she said, ‘Yes, Jonah, I already told you’.”
The account differs from the one given by the young woman during her two days on the stand last week.
She said that she never provided consent to having a threesome and that she resisted it physically when it began.
The incident ended when a friend of the woman demanded to be let into the room.
Williams and Ball were removed from the X-Men roster after the allegations surfaced and neither attend St. F.X. anymore.
The trial runs the rest of this week.
